Presumably because they could fly over the hole this spell makes.

Should units with death immunity be allowed to go through too ?
I envision this as looking like an Oblivion gate. Nothing can pass through, and frankly, I think it'd be cool if it had a random chance of striking anyone in a (small, 1-2 square) radius for lightning damage.
I was looking at this as a glob of "oblivion" that basically hovered in mid-air; not something that sits on the ground. That would be a good reason for flyers to be affected too. Sure, you could _theoretically_ fly over it, but that would bring a whole different dimension to the battle board. (See what I did there?)
Or "Bottomless Pit""Create Void" would be the harmless version, IMO.
